NO SE HAN PUBLICADO EN LA GACETA OFICIAL

Resumen: En la República Bolivaria na de Venezuela no se publican todas las Ga-
cetas Oficiales, hay instru mentos “perdidos”, cuyos números no aparecen. Se tr ata
de uno de los rasgos de la ausencia de Estado de derecho en el país y de la insegu-
ridad jurídica que reina en él .

Abstract: In the Bolivarian Republic of Venezuela, not all Official Gazettes are
published; there are 'missing' issues whose numbers do not appear. This is one of
the characteristics of the absence of the rule of law in the country and the leg al
uncertainty that prevails there.

Un porcentaje importante de las leyes que la Asamblea Nacional (AN) ha aprobado en
2023 ha terminado en el limbo porque no han sido publicadas aún en la Gaceta Oficial, por lo
tanto, técnicamente no han entrado en vigor ni se puede exigir su cumplimiento ni a las auto-
ridades ni a los ciudadanos.
El año pasado, el Parlamento venezolano aseguró haber dictado 14 instrumentos legisla-
tivos1, pero una revisión realizada por Acceso a la Justicia de la lista de textos arrojó que 4 de
ellos no han sido sometidos al último trámite para considerar que en realidad están vigentes2.
La cifra supone el 28,57 % del total.

Ley es obligatoria desde su publicación en la Gaceta Oficial o desde la fecha a posterior que
ella misma indique». Algo similar estipula la Ley de Publicaciones Oficiales, cuyo artículo
10 señala que «las leyes y demás actos jurídicos del Estado de efectos generales entrarán en
vigencia a partir de su publicación en la Gaceta Oficial de la República Bolivariana de Vene-
zuela».
