El texto que hoy presentamos al público es la tesis que consignamos para
optar al título de Doctor en Ciencias mención «Derecho», que fue defendida
ante un jurado evaluador y aprobada el 27 de julio de 2022.
La misma fue entregada originalmente para su defensa en noviembre de
2019, pero el acto académico sufrió un fuerte retraso a causa de la pandemia
del virus chino C-19, periodo en el cual, además, falleció nuestro tutor
Dr. Tulio Á L , lo que forzó una reconstitución del jurado. Esta
circunstancia nos obligó, luego de la defensa, a la revisión del texto y su
modicación, solamente en aspectos formales, pues algunos puntos que
entonces se presentaban como novedosos, ya no lo eran en 2022. Aprove-
chamos la ocasión para también modicar la redacción de algunos pasajes,
con los cuales nunca estuvimos satisfechos. Pero salvo esos cambios que
anunciamos, el texto se conserva el al original.
