LA AGONÍA DEL ESTADO DE
DERECHO EN VENEZUELA

Resumen: En este comentario escrito por su autor en defensa del Estado de dere-
cho, analiza aspectos de su agonía en Venezuela, luego de que a pesar de su inser-
ción en la Constitución de 1999, el mi smo fue instrumentalizado p ara el autorita-
rismo.

Abstract: In this commentary written in defense of the rule of law, its author
analyzes aspects of its agony in Venezuela, after despite its insertion in the 1999
Constitution, it was instrumentalized for authoritarianism.

En su escrito Sobre el Estado de Derecho en Venezuela y su desintegración bajo el ré-
gimen autoritario, el maestro Allan Brewer-Carías aborda las tareas pendientes desde la
promesa constituyente de 1999, como lo son el perfeccionamiento de la democracia y la
reconciliación política. No obstante, aquel proceso, del que él mismo formó parte, no condujo a
una mayor democratización del país, sino que fue instrumentalizado para el autoritarismo, con-
virtiendo a esta Carta Política en lo que denominó como un “instrumento antidemocrático”.
La Constitución de la República Bolivariana deVenezuela declara expresamente que se
constituye en un Estado democrático y social de derecho y de justicia (Artículo 2 ), pero éste,
según Brewer-Carías, se ha convertido realmente en una innovación histórica, como un Esta-
do de Derecho de mentira, falso y fraudulento. Ante esta degeneración del que antaño fue
considerado como un proceso constituyente de vanguardia en América Latina, se hace nece-
sario examinar la agonía que este consagrado Estado de Derecho sufre en tiempos recientes.
El Estado, en sí, tal como lo expresó Hegel, es la máxima realización de la humanidad.
Su concepción moderna se forjó en el seno del constitucionalismo europeo, el cual Eric Hos-
bawm situó en su acuñado “largo siglo XIX”, que toma parte desde 1789 hasta 1914. En
dicho período se tuvieron lugar las revoluciones más importantes, la reestructuración política,
económica y social del mundo, así como la transición hacia la modernidad.
De ese proceso emergió la soberanía institucional, una idea de Estado donde los legisla-
dores, como representantes del pueblo, eran los depositarios de la soberanía, y quienes esta-
