REPUBLICA BOLIVARIANA DE VENEZUELA

JUZGADO SUPERIOR CIVIL Y CONTENCIOSO ADMINISTRATIVO

DE LA CIRCUNSCRIPCIÓN JUDICIAL DE LA REGIÓN DE LOS ANDES.

BARINAS, 17 DE OCTUBRE DE 2007.-

En escrito presentado ante este Tribunal Superior, el día Martes Nueve (09) de Octubre de Dos Mil Siete (2007), por el Abogado I.A.S.B., venezolano, mayor de edad, titular de la cédula de identidad N° V-1.534.327 e inscrito en el Instituto de Previsión Social del Abogado bajo el N° 11.715, con el carácter de Apoderado Judicial del ciudadano A.L.B.P., venezolano, mayor de edad, titular de la cédula de identidad N° V-9.215.547, de profesión Bombero, con el grado de Sargento 1°, domiciliado en la ciudad de San C.d.e.T., ha interpuesto QUERELLA POR RECLAMACION DE PRESTACIONES SOCIALES Y OTROS CONCEPTOS LABORALES, así como INDEMNIZACION DE ENFERMEDAD OCUPACIONAL, contra el MUNICIPIO SAN C.D.E.T..

En la presente causa, el actor pretende el cobro de diferencia de prestaciones sociales, así como la indemnización por concepto de enfermedad ocupacional; al respecto se observa: las acciones intentadas se excluyen mutuamente por cuanto a las mismas se les aplican procedimientos diferentes, resultando por lo tanto incompatibles entre sí; es decir, no procede su admisión de manera conjunta.

Al respecto, se remite este Órgano Jurisdiccional al artículo 19, Quinto Aparte, de la Ley Orgánica del Tribunal Supremo de Justicia, por remisión del artículo 98 de la Ley del Estatuto de la Función Pública, el cual, establece la inadmisibilidad de la demanda:

cuando se acumulen acciones o recursos que se excluyan mutuamente o cuyos procedimientos sean incompatibles; o cuando no se acompañen los documentos indispensables para verificar si la acción o recurso es admisible…

En consecuencia, este Tribunal Superior, DECLARA INADMISIBLE la demanda por RECLAMACION DE PRESTACIONES SOCIALES Y OTROS CONCEPTOS LABORALES, así como INDEMNIZACION DE ENFERMEDAD OCUPACIONAL, por inepta acumulación de acciones, interpuesta por el ciudadano A.L.B.P., antes identificado, contra el MUNICIPIO SAN C.D.E.T..
