Resumen: El indudable crecimiento del arbitraje como medio alterno de resolución de
controversias por excelencia para el comercio internacional nos invita a explorar la si-
tuación de Latinoamérica, los retos y oportunidades que se presentan y el alcance que
puedan tener para el desarrollo de la región. Ante estas cuestiones, resulta relevante
hacer una revisión a algunos de los casos en Latinoamérica de arbitrajes por defecto de
ley, la revisión del sistema dualista en algunas jurisdicciones y cuáles son las oportuni-
dades con las que cuentan los centros arbitrales para dicho crecimiento. Este artículo
desarrolla algunas de esas oportunidades y explora transversalmente como el arbitraje
tiene un potencial crecimiento para la práctica en la región.
Abstract: The undoubted growth of arbitration as an alternative means of dispute reso-
lution par excellence for international trade invites us to explore the situation in Latin
America, the c hallenges and opportunities that arise and the scope they may have for
the development of the region. In view of these issues, it is relevant to review some of
the cases of default arbitration in Latin America, the review of the dualist system in
some jurisdictions and the opportunities that arbitration centers have for such growth.
This article develops some of those o pportunities and explores transversally how arbi-
tration has a potential growth potential for the practice in the region.
