Vista la anterior diligencia, de fecha 6 de Noviembre de 2009, suscrita por el ciudadano J.Á., titular de la cédula de identidad N° V-8.039.459, parte actora, debidamente asistido por la abogada S.M., inscrita en el Inpreabogado bajo el N° 523.527, por medio de la cual desiste de la presente demanda, este Tribunal lo HOMOLOGA en los términos en él planteados, de conformidad con lo establecido en el artículo 263 del Código de Procedimiento Civil.
