SALA DE CASACIÓN SOCIAL.
Caracas, 04 de mayo de 2004. Años: 194° y 145°.
Vistas las actuaciones de trámite y sustanciación realizadas en el presente recurso de casación y el contenido del Acta de fecha 27 de abril de 2004 donde se deja constancia de la no comparecencia del demandante recurrente a la audiencia oral, pública y contradictoria, esta Sala, de conformidad con lo previsto en el artículo 173 de la Ley Orgánica Procesal de Trabajo declara DESISTIDO el referido recurso de casación interpuesto contra la sentencia de fecha 9 de febrero de 2004, dictada por el Juzgado Primero Superior del Trabajo de la Circunscripción Judicial del Estado Nueva Esparta, en el procedimiento que por cobro de prestaciones sociales y otros conceptos laborales sigue el ciudadano J.A. CARRERAS ORTIZ, contra la sociedad mercantil TELEVISIÓN DE MARGARITA, C.A. (TELECARIBE).
Se condena en costas al recurrente, en conformidad con lo dispuesto en el artículo 175 de la Ley Orgánica Procesal del Trabajo.
Publíquese, regístrese y remítase este expediente al Tribunal de la causa, es decir, Juzgado Primero de Primera Instancia de Sustanciación, Mediación y Ejecución del Trabajo de la Circunscripción Judicial del Estado Nueva Esparta, con sede en La Asunción. Particípese esta remisión al Juzgado Superior de origen ya mencionado.
