EL CASO CAPRILES CONTRA VENEZUELA EN LA
CORTE INTERAMERICANA DE DERECHOS HUMANOS*

Resumen: En 2024, año de elecciones presidenciales en Venezuela, la Corte In-
teramericana de Derechos Humanos celebró audiencia pública sobre el caso pro-
movido por Henrique Capriles contra el Estado venezolano, en relación con las
irregularidades de la s elecciones presidenci ales de 2013. La demanda se originó
tras la negativa del Consej o Nacional Electoral y del Tribunal Supremo de Ju sticia
de atender sus denuncias por prácticas que favorecieron al oficialismo y que vul-
neraron sus derechos políticos, a la libertad de expresión y al acceso a recursos
efectivos, protegidos por la Conven ción Americana sobre Derechos Humanos. La
ausencia de representantes del Estado en el proceso contrastó con la participación
de la CIDH, que expuso un patrón de deterioro electoral en Venezuela, evidencia-
do en el uso de recursos públicos, control instituciona l y represión a la oposición.
La decisión de la Corte podría constituir una hoja de ruta para mejorar las condi-
ciones de los próximos comicios, fijando estándares de transparencia, igualdad y
garantías mínimas en procesos electorales en la región.

Abstract: In 2024, an electoral year in Venezuela, the Inter-American Court of
Human Rights held a public hearing on the case brought by Henrique Capriles
against the Venezuelan State concerning irregularities in the 2013 presidential elec-
tions. The claim originated after the National Electoral Council and the Supreme
Court of Justice failed to address his complaints about practices that favored the
ruling party and violated his political rights, freedom of expression, and access to ef-
fective remedies, all protected under the American Convention on Human Rights. The
absence of State representatives in the proceedings contrasted with the participation
of the IACHR, which highlighted a pattern of electoral deterioration in Venezuela, in-
cluding the misuse of public resources, institutional co-optation, and repression of the
opposition. The Court’s decision could serve as a roadmap to improve the conditions
of upcoming elections, setting standards of transparency, equality, and minimum
guarantees in electoral processes across the region.
