Resumen: El ensayo pre senta un análisis de la sentencia del caso NLRB v s. Noel
Canning de la Corte Suprema de los Estados Unidos, centrándose en las especifi-
cidades de la interpreta ción constitucional en el país en cuestión , y en la influencia
que tienen las teorías de la interpretación sobre el resultado del caso. En el curso
del mismo, se presentan los argumentos de las teorías de interpretación utilizadas
por los jueces Breyer y Scalia, quienes escriben, respectivamente, la sentencia ma-
yoritaria y la concurrencia parcial. Luego, se estudia el caso en concreto y las di-
símiles resoluciones que se alcanzan en cada una de las decisiones, explicando las
coincidencias y discrepanc ias entre ellas.

la interpretación, pragmatismo, originalísmo.
Abstract: The essay presents an analysis of the Supreme Court of the United Sta-
tes' decision in the case of NLRB vs. Noel Canning, focusing on the specifics of
constitutional interpretation in the country in question, and the influence that
theories of interpretation have on the outcome of the case. Throughout the essay,
the arguments of the interpretive the ories used by Justices Breyer and Scalia, who
respectively write the majority opinion and the partial concurrence, are presented.
Then, the specific case and the different resolutions reached in each of the deci-
sions are studied, explaining the similarities and differences between them.

theories, pragmatism, originalism.

La Constitución de los Estados Unidos supera ya los 235 años de existencia. Habiéndo-
se acordado en Filadelfia en 17871 e iniciado su vigencia el 4 de marzo de 17892, es la norma
