Algunas consideraciones esenciales
sobre la Hermenéutica Jurídica

Resumen
Se busca dejar en evidencia la tendencia a procurar una máxima expresión
de libertad en el ordenamiento, con relación al arbitrio judicial, indagando en los
principios en que deba construirse el proceso de interpretación jurídica; señalando
como objetivo general su análisis, mediante la precisión de los instrumentos utiliza-
dos por el Juez para formar su decisión. Dicho estudio basado en legislación, juris-
prudencia y doctrina nacional y extranjera, se realizó a través de una metodología
descriptiva, aplicada por medio de una técnica de investigación documental. Se lo-
gró precisar que la amplitud interpretativa responde al desafío, que impone la con-
secución de la justicia.
