Vista la decisión de la Corte Primera de lo Contencioso Administrativo, dictada en fecha 3 de abril de 2002, mediante la cual confirmó la medida de amparo cautelar, acordada en sentencia de fecha 6 de julio de 2001, en virtud del recurso de nulidad interpuesto conjuntamente con la referida acción cautelar, por los abogados L.J.D.O., L.P.M.G., A.B., A.R.P., Sacha F.C., L.C.G.G., R.S.M., R.J.C., R.S.R., Arazulis Espejo Sánchez y R.C., Directora General de los Servicios Jurídicos la primera, Directora de Recursos la segunda y Abogados Defensores adscritos a la referida Dirección de la Defensoría del Pueblo los demás, actuando todos por delegación del ciudadano G.M.H., en su condición de DEFENSOR DEL PUEBLO, en representación de los ciudadanos “...J.H. LÁREZ HERNÁNDEZ, HEBER BRICEÑO, WILFREDO DÍAZ, ARISTÓBULO ASTORGA, AMARILIS DE ASTORGA, P.S., M.S.D.R., F.R., J.H. LÁREZ HERNÁNDEZ (SIC), M.G.T., C.R.A., WILFREDO DÍAZ (SIC) Y N.R.G., titulares de las cédulas de identidad números 6.274.675, 2.981.091, 4.561.391, 652.391, 797.054, 54.472, 4.250.409, 2.157.225, 12.066.871 y 6.140.302 respectivamente...”, contra “...los actos administrativos de autoridad fechados los días 7, 8 y 11 de febrero, 5 y 11 de mayo, todos del año 2000...”, dictados por “...el holding conformado por las empresas C.A., LUZ ELÉCTRICA DE VENEZUELA, C.A. La ELECTRICIDAD DE CARACAS Y ADMINISTRADORA SERDECO, C.A....”.
Visto igualmente que la sentencia objeto de consulta fue dictada en fecha 3 de abril de 2002 y que el expediente contentivo de las copias certificadas relacionadas con dicha consulta, fue remitido por la Corte Primera de lo Contencioso Administrativo, mediante Oficio Nº 3137 del 03 de julio de 2002, la Sala acuerda para mejor proveer, de conformidad con el artículo 129 de la Ley Orgánica de la Corte Suprema de Justicia, abrir un lapso de seis (6) días de despacho, contados a partir de la notificación por oficio del presente auto al referido órgano jurisdiccional, a los fines de que informe a esta Sala sobre el estado de la acción principal cursante en el Expediente N° 01-25169, según nomenclatura llevada por dicho tribunal.
Publíquese, regístrese y notifíquese. Remítase mediante oficio copia certificada del presente auto a la Corte Primera de lo Contencioso Administrativo. Cúmplase lo ordenado.
