Resumen: Estudio sobre aspectos relevantes del complejo juego de relaciones que
configuran la cultura, el derecho y la economía, dentro de áreas académicas dife-
rentes; el derecho de la cultura, como nueva disciplina jurídica; el derecho a la
cultura, derecho humano que el Estado debe incluir y garantizar dentro de sus po-
líticas gubernamentales; y, en su dimensión económica, la economía de la cultura,
con la impetuosa diná mica de las industrias c ulturales cuya actividad comercial
constituye una fuente de riqueza significativ a para los países que la producen y
distribuyen en forma de bienes y servicios culturales.

Abstract: Study on relevant aspects of the complex set of relations that comprise
culture, law and economics , within different acade mic fields; Cultural Law, as a
new legal discipline; Right to Culture, a human right that the State is to recognize
and protect by law as part of its governmental politics; and within its economic
measurement, Cultural Econo mics, with the cultural indu stry’s impetuous dynam-
ics which account for a meaningful source of wealth for the countries that produce
and distribute it in the for m of cultural goods and services.

INTRODUCCIÓN
El objetivo de este artículo es ofrecer una mirada desde las ciencias sociales del comple-
jo juego de relaciones que configuran hoy la cultura, en particular, sus intercambios con el
derecho y la economía en la etapa actual de su hiper especialización, aprovechamiento y
desarrollo por parte de los estados nacionales y sectores empresariales.
Para comenzar resulta imperativo subrayar el carácter polisémico de la voz cultura lo
que ha constituido un reto de gran magnitud a los fines de su definición y ubicación dentro de
