ABOGADO ASISTENTE: E.G.E.H. y G.C.R.M. inscritas en el Inpreabogado bajo los Nros 41.093 y 44.664 respectivamente.
MOTIVO: RECTIFICACIÓN DE ACTA DE NACIMIENTO.
SENTENCIA INTERLOCUTORIA
Vista la solicitud presentada por las abogadas E.G.E.H. y G.C.R.M. inscritos en el Inpreabogado bajo los Nros 41.093 y 44.664 respectivamente actuando en su carácter de apoderadas judiciales del ciudadano L.R.M. titular de la cedula de identidad Nro. V-5.579.039 mediante la cual solicitan la RECTIFICACIÓN DE SU ACTA DE NACIMIENTO el Tribunal a los fines de pronunciarse sobre su competencia observa:
De acuerdo con lo dispuesto en el artículo 501 del Código Civil, la competencia en materia de rectificación de actas de estado Civil, le está atribuida expresamente al Juez cuya jurisdicción corresponda a la parroquia o municipio donde se extendió la partida.
En el caso sub iudice, observa este Juzgado que, el asunto sometido a la consideración de este Órgano Jurisdiccional, está relacionado con la rectificación del acta de nacimiento del ciudadano L.R.M., anteriormente identificado, expedida de acuerdo con lo afirmado en la solicitud por el Registro Civil de la Parroquia San J.d.L.M., actuación esta que le está expresamente atribuida a los Juzgados de Municipios Ordinarios y Ejecutores de Medidas de los Municipios J.G.R., Ortíz y J.M. con sede en San J.D.l.M., Circunscripción Judicial del Estado Guarico.
En consideración a los criterios expuestos, este Tribunal se declara incompetente; y en consecuencia, declina el conocimiento del presente asunto a un Juzgado de Municipio Ordinario y Ejecutor de Medidas de la Circunscripción Judicial de los Municipios J.G.R.O. y J.M.d.E.G., con sede en San J.d.L.M., para que, previa la correspondiente distribución, conozca de la presente solicitud, y así se decide.

En virtud de los razonamientos antes expresados, este Juzgado Cuarto de Municipio Ordinario y Ejecutor de Medidas de la Circunscripción Judicial del Área Metropolitana de Caracas, administrando justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley, declina su competencia por el territorio a un Juzgado de Municipio Ordinario y Ejecutor de Medidas de los Municipios J.G.R.O. y J.M.d.E.G., con sede en San J.d.L.M.. Así se decide.
