Revisadas como han sido el escrito de solicitud y los recaudos anexos, presentado por el ciudadano J.R.P.A., titular de la cédula de identidad Nº V- 5.417.285, asistido por la abogada R.J.P.M., inscrita en el Inpreabogado bajo el Nº 19.061, a través del cual solicita de JUSTIFICATIVO DE TESTIGO, con la finalidad de que se obtenga justificativo suficiente motivado de la unión estable de hecho (concubinato) que mantiene con su pareja la ciudadana LUXI Y.U.R.; el Tribunal efectúa las siguientes consideraciones:
Asimismo, debe necesariamente este Despacho resaltar, que de conformidad con nuestro ordenamiento jurídico, las relaciones (concubinarias) UNION ESTABLE DE HECHO O ACCION MERO DECLARATIVA DE HECHO, son solicitadas por un Registro Civil o en los Tribunales de Primera Instancia.
En consecuencia de todo lo anteriormente expuesto este Juzgado Undécimo de Municipio Ordinario y Ejecutor de Medidas de la Circunscripción Judicial del Área Metropolitana de Caracas, administrando justicia NIEGA la evacuación de la solicitud de Justificativo de Testigo presentada por el mencionado solicitante supra identificado. Y así se decide.-
