JUZGADO AGRARIO PRIMERO DE PRIMERA INSTANCIA DE LA
CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO CARABOBO.

Visto que en sesión del 12 de Agosto de 2.015, la Comisión Judicial del Tribunal Supremo de Justicia, me designó como Juez Provisorio del Juzgado Agrario Primero de Primera Instancia de la Circunscripción Judicial del estado Carabobo, conforme a Oficio Nº CJ-15-3127, En este sentido, me ABOCO AL CONOCIMIENTO DE LA CAUSA, en estrecho apego a los principios establecidos en los artículos 2, 7 y 26 de la Constitución de la Republica Bolivariana de Venezuela. Asimismo, se le indica que conforme se ha establecido respecto al avocamiento, en reiterada doctrina de la Sala Civil del Tribunal Supremo de Justicia – véase fallo del 07.03.2002., resulta conveniente recordar:
…se reitera el criterio asentado en relación con los siguientes puntos: El nuevo juez que deba conocer la causa deberá avocarse a la misma, mediante auto expreso. Si el avocamiento del juez ocurre dentro del lapso de sentencia y su prorroga no será necesario notificar a las partes al respecto, en virtud del principio de que ellas se encuentra a derecho. Si el avocamiento ocurre después de vencido el lapso para sentenciar y su prorroga, el nuevo juez deberá notificar a las partes de su avocamiento, para que estas tenga la oportunidad de controlar la capacidad subjetiva del sentenciador a través de la figura de la recusación; si ello es necesario…

Por lo antes expuesto, a fin de procurar la integridad de la legislación y la uniformidad de la citada jurisprudencia, se evidencia que las partes se encuentran a derecho en el presente asunto. En tal sentido, se les hace saber que la causa continuará su curso legal al tercer (3º) día de despacho siguiente, de conformidad con lo dispuesto en los artículos 14 y 90 del Código de Procedimiento Civil. Lo anterior a los fines de hacerse del correspondiente recurso.
