Cuando se hace referencia al contrato de distribución en su sentido amplio,
se enfatiza fundamentalmente en la actividad intermediadora386, y en esta
categoría se incluyen a los contratos de agencia, concesión, distribución
propiamente dicha y a la franquicia387.
En aras de evitar confusiones, a continuación se realizará un aná lisis com-
parativo entre el contrato de distribución en su sentido estricto y los con-
tratos de agencia, y franquicia de distribución, los cuales son considerados
contratos de distribución en su sentido amplio.
Así mismo, se comparará al contrato de distribución con el contrato
de comi sión.

La doctrina ha denido el contrato de agencia como aquel por el cual una
persona física o jurídica, denominada «agente», se obliga frente a otra, de ma-
nera continuada y estable a cambio de una remuneración, a promover actos
u operaciones de comercio por cuenta ajena, o a promoverlos y concluirlos
