Resumen
La Sala de Casación Penal del Tribunal Supremo de Justicia,
determinó en la sentencia 554 del 29 de octubre de 2009, que
el delito de homicidio a título de dolo eventual no se encontraba
consagrado en la ley penal venezolana. La Sala Constitucional
anuló tal fallo y estableció las bases jurídico-penales para una
correcta interpretación y aplicación del dolo eventual,
considerándolo implícito en el artículo 61 del Código Penal.

legalidad.
Casual malice in the Supreme Tribunal of Justice:
analysis of sentence No. 554 from the Criminal
Appeals Chamber and sentence No. 490 from the
Constitutional Chamber
Abstract
In sentence no. 554, October 29, 2009, the Chamber of
Criminal Appeal declared that the crime of murder with casual
malice does not exist in Venezuelan criminal law. The
Constitutional Chamber overturned that decision and
established the grounds for the correct interpretation and
application of casual malice, considering it to be implicit in
Article 61 of the Criminal Code.
