Vista la actuación de fecha 26 de enero de 2011, suscrita por la Magistrada Evelyn Marrero Ortíz, mediante la cual manifiesta su voluntad de inhibirse en esta causa, en virtud de haber emitido opinión en el caso, al suscribir la decisión dictada el 6 de julio de 2001, por la Corte Primera de lo Contencioso Administrativo, relacionada con el recurso contencioso administrativo de nulidad ejercido; y por cuanto del examen de las actas que conforman el expediente se desprende que en efecto se ha verificado la causal de inhibición alegada, esto es, la prevista en el numeral 5 del artículo 42 de la Ley Orgánica de la Jurisdicción Contencioso Administrativa, en consecuencia, es procedente declarar con lugar la inhibición propuesta por la mencionada Magistrada. Así se decide.
Practíquese la convocatoria del respectivo suplente, conjuez o conjueza, de conformidad con lo establecido en el artículo 59 de la Ley Orgánica del Tribunal Supremo de Justicia, publicada en Gaceta Oficial de la República Bolivariana de Venezuela N° 5.991 Extraordinario del 29 de julio de 2010. Cúmplase lo ordenado.
