GADO PRIMERO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL Y AGRARIO DE LA CIRCUNSCRIPCION JUDICIAL DEL ESTADO CARABOBO.-

DEMANDANTE: ESTACIONAMIENTO CARABOBO
MOTIVO: AUTO INTERLOCUTORIO
EXPEDIENTE: 50.711
De una revisión realizada al expediente número 50.711, nomenclatura interna de este Tribunal, esta Sentenciadora se abstiene de proveer la solicitada decisión al encontrar las siguientes situaciones no solventadas y las cuales se requieren a los fines legales, por cuanto se estiman medulares en la decisión sobre el mérito:
1°) Por imperativo del artículo 20 de la Ley Orgánica de Hacienda Pública Nacional, quien tiene cualidad para pedir la incorporación al Patrimonio Nacional tanto de bienes muebles como inmuebles que se encuentren en el Territorio de la República es el Procurador General de la República y no un Tercero como sucede en el presente caso; por manera que, no consta en autos la notificación de este Funcionario público a los fines de que exponga lo conducente, ratificando o nó el pedimento del tercero; se hace en consecuencia, necesario ratificar el oficio de su notificación y por este auto se ordena.
2°) Se constata que tampoco consta, que el Procurador General de la República, haya autorizado al solicitante para actuar en su nombre; otra razón más para que la notificación del referido funcionario se haga presente en este caso, todo lo cual induce a ratificar la notificación que antecede, y ASÍ SE DECLARA.
3°) En fecha 13 de diciembre de 2004, fue expedido oficio Nro. 2.428, dirigido a M.H.M., en su carácter de Procuradora General de la República, se evidencia que esta ciudadana no detenta tal cargo, razón por la cual se deja sin efecto el referido oficio, y se ordena expedir nuevo oficio dirigido al Procurador (a) General de la República, que lo es la Dra. M.P.Y..

(BANCO UNIVERSAL), contra la Sociedad Mercantil M & M, INVERSIONES, C.A.. De cuya exactitud doy fe, todo de conformidad con lo establecido en los artículos 111 y 112 del Código de Procedimiento Civil. En Valencia los Ocho (08) días del mes de Marzo del año 2.005. Años 194° de la Independencia y 146° de la Federación.
