Resumen
Este artículo presenta un estudio cualitativo centrado en la eutanasia activa en Ecuador durante el período 2024-
2025. El análisis se enfoca en las im plicaciones legales y sociales que este fenómeno genera en el contexto
ecuatoriano, examinando la interacción entre el m arco constitucional y legal vigente y la práctica de la e utanasia
activa. La investigación identifica los principales conflictos, dilemas y discursos institucionales que emergen en
torno a su regulación y aplicación. Para ello, se aplicó una metodología hermenéutica y dogmática bas ada en el
análisis documental y normativo, que incluyó leyes, decisiones judiciales, fuentes doctrinales y pronunciamientos
de entidades com petentes. Los hallazgos revelan vacíos normativos significativos, interpretaciones divergen tes
en la jurisprud encia, y tens iones sociales que enfrentan el derecho a la muerte digna con la resistencia ética e
institucional. A partir de estos resultados, el estudio pr opone nuevas perspectivas para construir un marco legal
coherente que favorezca un diálogo s ocial informado y respetuoso sobre esta c uestión compleja y sensible. Así,
se busca aportar insumos que contribuyan a un debate público equilibrado y a la elaboración de políticas jurídicas
que aborden las necesidades y preocupaciones de la sociedad ecuatoriana.

Abstract
This article presents a qualitative study focused on active euthanasia in Ecuador during the period 2024 -2025.
The analysis centers on the legal and social implications of this phenomenon in the Ecuadorian context, examining
the interaction between the current co nstitutional and legal framework and the practice of active euthanasia. The
research identifies the main conflicts, dilemmas, and institutional discourses that emerge around its regulation and
application. To this end, a hermeneutic and dogmatic methodology was applied, based on documentary and
normative analysis, which included laws, judicial decisions, doctrinal sources, and pron ouncements from
competent entities. The findings reveal significant regulatory gaps, divergent interpretations i n jurisprudence, and
social tensions that pit the right to a dignified death against ethical and institutional resistance. Based on these
results, the study proposes new perspectives for building a coherent legal framework that fosters an informed and
respectful social dialogue on this complex and sensitive issue. Thus, the aim is to provide input that contributes to
a balanced public debate and the development of legal policies that address the needs and concerns of Ecuadorian
society.

Introducción
El tema de la eutanasia activa ha sido uno de los más controvertidos en el ámbito legal y social de nuestra
época, ya que impacta directamente en el derecho a la vida, el principio de autonomía personal y la dignidad
humana. Durante el periodo de debate j udicial y social en Ecuador, entre 2024 y 20 25, en torno a su posi ble
legalización y regulación, surgieron múltiples interrogantes acerca de la legalidad, la ética y las instituciones
involucradas, así como las tensiones fundamentales con las convicciones sociales predominantes.
En el plano internacional, esta investigación se enmarca dentro de los Objetivos de Desarrollo Sostenible,
especialmente los ODS 3 y 16, y en directrices técnicas específicas como la Guía de la OMS sobre Cuidados
Paliativos y Atención al Final de la Vida de 2018, el Informe del Consejo de Derechos Humanos A/HRC/41/7 de
2019 y los Principios de Siracusa de 1984 sobre la limitación de derechos. Estos instrumentos definen parámetros
