Resumen: El artículo exami na si el V Concurso de Credenciales y Conocimientos
de la Carrera Defensoril garantiza la independencia de los defensores públicos en
Venezuela. Aunque la convocatoria cumple formalmente con la publicidad exigida
por la ley, el análisis demuestra que el proceso no es realmente abierto, pues está
limitado exclusivamente a defensores provisionales previamente designados de
forma discrecional, exclu yendo a profesionales externos que podrían cumplir los
requisitos para el cargo . Este diseño reproduce la precariedad inst itucional que ha
caracterizado a jueces, fiscales y defensores públicos provisorios, cuya falta de es-
tabilidad los hace vulnerable s a presiones políticas. Asimismo, la res olución que
regula el concurso contiene vacíos significativos en materia de transparencia, co-
mo la ausencia de criterios para seleccionar al jurado y dudas sobre la publica-
ción efectiva de l istas para el control ciudadano. Aunque la regularización podría
ser una vía para otorgar estabilidad, no garantiza por sí sola independencia ni
idoneidad. En conjunto , el artículo concluye que el concurso mantiene prácticas
discrecionales que afectan la in dependencia de la Defensa Pública y, en conse-
cuencia, el derecho de las personas a una defensa real y justa.

Abstract: The article examines whether the Fifth Credential and Knowledge-
Based Competition for the Public Defender Career guarantees the independence of
public defenders in Venezue la. Although the call formally compl ies with the publi-
city requirements set by law, the analysis shows that the process is not truly open,
as it is limited exclusively to provisional public defenders previously appointed at
the discretion of authorities, thereby excluding external professionals who could
meet the qualifications for the position. This design reproduces the institutional
precariousness long seen amon g provisional judges, prosecutor s, and public de-
fenders, whose lack of stability makes them vulnerable to political pressure.
