REPUBLICA BOLIVARIANA DE VENEZUELA
EN SU NOMBRE
JUZGADO SUPERIOR SEXTO DE LO CONTENCIOSO ADMINISTRATIVO DE LA REGION CAPITAL
En fecha 07 de noviembre de 2007, se recibió del Juzgado Superior Sexto de lo Contencioso Administrativo de la Región Capital (distribuidor de turno) escrito contentivo de la querella funcionarial interpuesta por las abogadas OFELMINA LOZANO VARGAS y Y.A.B., inscritas en el inpreabogado bajo los Nros. 81.770 y 76.373, actuando en su carácter de apoderadas judiciales del ciudadano BERROTERAN C.H.E., portador de la cédula de identidad Nro. 7.997.549, mediante la cual solicita el pago de la diferencia de prestaciones sociales al Cuerpo de Policía Metropolitana de Caracas.
En fecha 08 de noviembre de 2007 este Juzgado dictó Sentencia declarando Inadmisible la querella funcionarial interpuesta por haber operado la Caducidad de la Acción.
En fecha 15 de noviembre de 2007 se dictó auto mediante el cual se oyó en ambos efectos la apelación interpuesta por la parte actora mediante diligencia de fecha 13 de noviembre de 2007, contra la decisión dictada por este Juzgado en fecha 08 de noviembre de 2007 y en consecuencia se ordenó remitir el expediente a la Unidad de Recepción y Distribución de Documentos de las C.P. y Segunda de lo Contencioso Administrativo.
En fecha 29 de marzo de 2012 la Corte Primera de lo Contencioso Administrativo dictó decisión mediante la cual declaro con lugar el Recurso de Apelación interpuesto y en consecuencia revocó la sentencia dictada por este Juzgado en fecha 08 de noviembre de 2007 y ordenó pronunciarse sobre la admisión del presente recurso.
En fecha 27 de septiembre de 2012 se dictó auto mediante el cual se admitió la querella funcionarial interpuesta en cumplimiento a la decisión dictada por la Corte Primera de lo Contencioso Administrativo y se ordenó a la parte actora consignar los fotostatos correspondientes para practicar la respectiva notificación y citación libradas.

MOTIVACIÓN PARA DECIDIR
Este Tribunal observa:
Una vez revisadas las actas procesales que conforman el presente expediente, se constata que desde el 27 de septiembre de 2012, fecha en la cual fue admitida la querella funcionarial y hasta el día de hoy, ha transcurrido más de un (01) año, sin que la parte interesada compareciera a instar la causa para que procediera la continuación del juicio, encuadrándose la situación descrita en lo establecido en el artículo 267 del Código de Procedimiento Civil, el cual dispone que toda instancia se extingue por el transcurso de un (01) año sin haberse ejecutado ningún acto de procedimiento por las partes. Dicho término empezará a contarse a partir de la fecha en que se haya efectuado el último acto procesal, por lo que en tal caso debe declararse la perención de oficio.-

DECISIÓN
En mérito de lo anterior, este Juzgado Superior Sexto de lo Contencioso Administrativo de la Región Capital, administrando Justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley declara CONSUMADA LA PERENCIÓN y EXTINGUIDA LA INSTANCIA, en la querella funcionarial interpuesta por las abogadas OFELMINA LOZANO VARGAS y Y.A.B., inscritas en el inpreabogado bajo los Nros. 81.770 y 76.373, actuando en su carácter de apoderadas judiciales del ciudadano BERROTERAN C.H.E., portador de la cédula de identidad Nro. 7.997.549, mediante la cual solicita el pago de la diferencia de prestaciones sociales al Cuerpo de Policía Metropolitana de Caracas.
Publíquese, regístrese y notifíquese.
Dada, firmada y sellada en la Sala de Despacho del Juzgado Superior Sexto de lo Contencioso Administrativo de la Región Capital, en Caracas a los diez (10) días del mes de enero de dos mil catorce (2014). Años 203º de la Independencia y 154º de la Federación.
