Visto la diligencia presentada el 13 enero 2010 por el abogado O.P.A., cédula de identidad V-3.044.352, Inpreabogado Nº 19.131, con carácter de apoderado judicial de los ciudadanos H.H. e ISAM HILAL HILAL, cédulas de identidad V-12.768.822 y V-8.666.350, mediante el cual expone “Desisto de la presente acción y del procedimiento interpuesta contra el INSTITUTO NACIONAL DE ESTADISTICAS; este Juzgador observa que el desistimiento no es contrario al orden público, a la moral, buenas costumbres ni disposición expresa de la ley que impida su homologación, en razón de lo cual este Juzgado impartiendo justicia en nombre de la República Bolivariana de Venezuela por autoridad de la Ley declara Homologado el desistimiento realizado por la parte demandante. Archívese el expediente.
