Resumen: Desde el año 2000, el Tribunal Supremo de Justicia (TSJ) de Venezuela
ha desarrollado una línea jurisprudencial que afecta la autonomía de colegios y
gremios profesionales mediante la anulación de normas legales, la suspensión de
procesos electorales y la designación de juntas directivas ad hoc. Estas interven-
ciones, documentadas en al me nos doce decisiones desde 2007, restringen el dere-
cho a la asociación consagrado en el artículo 52 de la Constitución y en tratados
internacionales ratificados por el país. Aunque el TSJ se ha amparado en los ar-
tículos 293.6 de la Constitución y 27.2 de la Ley Orgánica del TSJ, el uso de estas
disposiciones ha tenido como resultado la limitación de la aut onomía gremial en
lugar de su fortalecimiento . Tales decisiones también se apartan de estándares in-
ternacionales como el Conv enio 87 de la OIT, que pro tege la libertad de asocia-
ción tanto de trabajadores como de e mpleadores. En consecuencia, la intervención
del TSJ reduce la capacidad de los gremios de representar a sus miembros, debili-
ta su incidencia en la vida pública y genera una dependencia institucional que ero-
siona la libertad de asociación y la autonomía profesional en Venezuela.

Abstract: Since 2000, the Supreme Cou rt of Justice (TSJ) of Venezuela ha s deve-
loped a line of jurisprudence that undermines the autonomy of professional asso-
ciations and bodies through the annulment of legal provisions, the suspension of
electoral processes, and the appointment of ad hoc boards of directors. These in-
terventions, documented in at least twelve decisions since 20 07, restrict the right of
association enshrined in Article 52 of the Constitution and in international treaties
ratified by the country. Although the TSJ has relied on Articles 293.6 of the Consti-
tution and 27.2 of the Organ ic Law of the TSJ, the use of these provisions has re-
sulted in the limitation ra ther than the strengthening of pr ofessional autonomy.
Such rulings also depart from international standards such as ILO Convention No.
87, which protects freedom of association for both workers and employers. Conse-
