Por los fundamentos antes expuestos, este JUZGADO SEGUNDO DE EJECUCIÓN DEL CIRCUITO JUDICIAL PENAL DEL ESTADO ZULIA, Administrando Justicia en Nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley NIEGA POR IMPROCEDENTE EL BENEFICIO DE REGIMEN ABIERTO al penado J.C.B., Venezolano, de 18 años de edad, soltero, de profesión u oficios obrero, titular de la cedula de identidad Nº 22.159.156, hijo de Segundo Bencomo y de B.B., residenciado en La calle MN, Sector Altos de Jalisco, casa Nº 1-55 Maracaibo, Estado Zulia, quien fue condenado, a cumplir la pena de DIEZ (10) AÑOS DE PRISION, y a las penas accesorias de Ley, por haber resultado autor culpable y responsable en la comisión del delito de ROBO AGRAVADO, previsto y sancionado en el Artículo 458 del Código Penal, en perjuicio de los ciudadanos I.A.S.N. y J.A.S.M., por cuanto no cumple con los requisitos establecido en el artículo 500 del Código Orgánico Procesal Penal. Por lo que se oficia a tal fin para que se canalice los factores que dieron origen al informe técnico desfavorable.
