JUZGADO AGRARIO PRIMERO DE PRIMERA INSTANCIA DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO CARABOBO

AUTO DE IMPULSO PROCESAL Y SEGURIDAD JURÍDICA.
Visto el auto de fecha 17/12/08 (folio 206), en el cual se ordena la notificación mediante edicto de los herederos desconocidos del codemandado R.O.B., el cual falleció 19/05/07, según consta en acta de defunción inserta en el presente expediente en el folio 182, este Tribunal observa la omisión del emplazamiento de los herederos conocidos, así como también error de trascripción del apellido del fallecido el cual no es OVIEDO, sino OVIDIO, tal como se desprende de la ya mencionada acta de defunción, en el libelo de la demanda (folio 1 al 2), y en el documento de Constitución de Hipoteca (folio 14 al 27, en consecuencia, para evitar reposiciones inútiles ordena de oficio la notificación de los herederos conocidos y desconocidos, así como también a todos aquellos que se crean asistido de derechos de conformidad con lo establecido en el artículo 231 del Código de Procedimiento Civil. Por lo cual ordena publicar edicto en los diarios “NOTITARDE” y “CARABOBEÑO”, en un término de sesenta (60) días calendarios, dos (02) veces por semana. Entréguese el correspondiente edicto en ejemplar físico y digital a la parte demandante.
