SENTENCIA INTERLOCUTORIA DE SOBRESEIMIENTO
Visto el escrito presentado por el ABG. J.A.F.R., en su carácter de Fiscal Quinto del Ministerio Público (E), mediante el cual solicita a este Tribunal, El SOBRESEIMIENTO DE LA CAUSA, seguida en contra de J.D.V.M. por el delito de ABANDONO DE NIÑOS O DE OTRAS PERSONAS INCAPACES DE PROVEER A SU SEGURIDAD O A SU SALUD, previsto y sancionado en el artículo 437 del Código Orgánico Procesal Penal en perjuicio de YULEXIS DEL VALLE MARCANO, hecho ocurrido en fecha 06-06-2002, de conformidad con lo establecido en el artículo 318, ordinal 4°, del Código Orgánico Procesal Penal, en virtud que a pesar de la falta de certeza, no existe razonablemente la posibilidad de incorporar nuevos datos a la investigación y no existen bases para solicitar el enjuiciamiento del imputado.
DISPOSITIVA
Por lo antes expuesto y previo análisis de la presente causa, estima ésta Juzgadora que para comprobar los motivos que fundamentaron la presente solicitud de sobreseimiento, no es necesario el debate oral, motivo por el cual se pasa a dictar sentencia en los siguientes términos: Este Tribunal Quinto de Control del Circuito Judicial Penal del Estado Sucre, Extensión Carúpano, Administrando Justicia en Nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, DECRETA EL SOBRESEIMIENTO DE LA PRESENTE CAUSA, seguida en contra de J.D.V.M. por el delito de ABANDONO DE NIÑOS O DE OTRAS PERSONAS INCAPACES DE PROVEER A SU SEGURIDAD O A SU SALUD, previsto y sancionado en el artículo 437 del Código Orgánico Procesal Penal en perjuicio de YULEXIS DEL VALLE MARCANO, por cuanto a pesar de la falta de certeza, no existe razonablemente la posibilidad de incorporar nuevos datos a la investigación y no existen bases para solicitar el enjuiciamiento del imputado, todo de conformidad con lo establecido en el artículo 318, ordinal 4° y 323, ambos del Código Orgánico Procesal Penal. En consecuencia se ordena notificar a las partes de la presente decisión, remítase la causa a la Fase de Ejecución en su debida oportunidad. Líbrense notificaciones.-
