RESUMEN
El objetivo de la investigación fue analizar las limitaciones estructurales a la autonomía
sancionadora desde la transparencia y eficiencia en procedimientos administrativos
disciplinarios en Áncash, Perú. Investigación de nivel descriptivo-interpretativo con
enfoque cualitativo, manejando la recolección y análisis de una tipología documental-
bibliográfica en el que se revisaron fuentes legales y artículos arbitrados relacionados
con el tema de estudio, complementado con trabajo de campo. En la fase de campo, se
llevó a cabo entrevistas semiestructuradas, que fueron aplicadas de manera presencial a
ocho operadores judiciales: cuatro secretarios técnicos y cuatro secretarios técnicos
suplentes. En conclusión, el procedimiento administrativo disciplinario del Poder Judicial
presenta una autonomía sancionadora reconocida en el plano normativo que no se
proyecta de manera efectiva en su funcionamiento organizacional. La estructura vigente
permite que la fase instructora genere un análisis jurídico y probatorio relevante.

ABSTRACT
The objective of the research was to analyze the structural limitations to sanctioning
autonomy from the transparency and efficiency of administrative disciplinary procedures
in Ancash, Peru. Descriptive-interpretative research with a qualitative approach,
managing the collection and analysis of a documentary-bibliographic typology in which
legal sources and refereed articles related to the subject of study were reviewed,
complemented with fieldwork. In the field phase, semi-structured interviews were carried
out, which were applied in person to eight judicial operators: four technical secretaries and
four alternate technical secretaries. In conclusion, the administrative disciplinary
procedure of the Judicial Branch has a sanctioning autonomy recognized at the normative
level that is not effectively projected in its organizational functioning. The current structure
allows the investigative phase to generate a relevant legal and evidentiary analysis.
