En el día de hoy, veintinueve (29) de noviembre 2012, siendo las 9:00 am, oportunidad prevista para la Prolongación de la Audiencia Preliminar en la causa signada con el Nº FP11-L-2012-000931. Este Tribunal deja expresamente establecido que anunciado el acto procesal a las Puertas de la Sede del Circuito Judicial del Trabajo, lugar donde funciona este Juzgado, se evidenció la incomparecencia de ambas partes a la Prolongación de la Audiencia Preliminar. Siendo ello así se procede a aplicar la consecuencia jurídica de incomparecencia a la parte accionate, quién no compareció ni por si ni por medio de apoderado judicial alguno. En tal sentido, vista la incomparecencia de la parte actora a la Prolongación de la Audiencia Preliminar, este TRIBUNAL TERCERO DE PRIMERA INSTANCIA, DE SUSTANCIACIÓN, MEDIACIÓN Y EJECUCIÓN DEL TRABAJO DEL ESTADO BOLIVAR, SEDE PUERTO ORDAZ, administrando justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley, DECLARA DESISTIDO EL PROCEDIMIENTO Y TERMINADO EL PROCESO, en la presente causa, de conformidad con lo previsto en el artículo 130 de Ley Orgánica Procesal del Trabajo. Es todo, terminó, se leyó y conforme firma.-
