Resumen
El presente estudio tuvo como objetivo analizar el marco legal peruano aplicable a los contratos bajo la modalidad
Engineering, Procurement and Construction (EPC), en el contexto de un Estado constitucional de derecho. Para
ello, se empleó una metodología cualitativa con enfoque hermenéutico, sustentada en una revisión bibliográfica
sistemática y multimodal. El diseño fenomenológico permitió interpretar y contrastar la información documental
con entrevistas a expertos en derecho, ingeniería y gestión pública. La selección de fuentes se realizó en bases
de datos científicas indexadas, siguiendo criterios de inclusión y exclusión previamente establecidos. Los
resultados evidenciaron un uso creciente de los contratos EPC en megaproyectos peruanos, a pesar de la
ausencia de una regulación específica. Esta situación convierte a los contratos EPC en figuras atípicas dentro del
ordenamiento jurídico nacional, lo que genera vacíos normativos que afectan la distribución de riesgos,
incrementan los costos transaccionales y, con frecuencia, derivan en arbitrajes internacionales. Asimismo, las
entrevistas revelaron un limitado conocimiento técnico-jurídico por parte de los funcionarios públicos, lo que
restringe el control y la fiscalización efectivos de estos contratos. En conclusión, la falta de un m arco normativo
específico propicia inequidades estructurales y distorsiones contractuales. Por tanto, se propone la creación de
