Visto y estudiado el escrito presentado por la Fiscal para el Régimen Procesal Transitorio del Ministerio Público, Abg. Z.C.M., mediante el cual solicita el SOBRESEIMIENTO DE LA CAUSA conforme al Ordinal 1° del Artículo 318 del Código Orgánico Procesal Penal, el cual establece que el Sobreseimiento procederá cuando considere que el hecho objeto del proceso no se realizó o no puede atribuírsele al imputado; solicitud ésta que consta en la Investigación Penal contenida en las actuaciones de la causa, seguida en contra de M.D.L.Á.G., por el delito de ABORTO en perjuicio del FETO, este Juzgado en funciones de Control para decidir considera:
Del estudio minucioso y exhaustivo de las actuaciones que sustentan la solicitud Fiscal, se observa que no ofrece elementos de convicción suficientes e idóneos que sirvan de base para fundamentar el enjuiciamiento oral y público, no existiendo posibilidad de incorporar nuevos datos en la investigación con las cuales se pueda suplir la falta de certeza en la imputación del hecho, en consecuencia de lo cual es procedente y ajustado a derecho es aceptar la solicitud Fiscal y Ordenar el Sobreseimiento de la Causa de conformidad con lo dispuesto en el Ordinal 1° del Artículo 318 del Código Orgánico Procesal Penal
