Admitida la demanda por COBRO DE BOLÍVARES POR EL PROCEDIEMTO DE INTIMACION, presentado por las Abogadas en ejercicio M.A.G. Y M.L.C., venezolanas, mayores de edad, IPSA Nos. 71.921 y 119.179, titulares de las cedulas de identidad Nros. 12.303.448 y 15.192.849, respectivamente, en sus caracteres de Endosatarias por “ENDOSO EN PROCURACIÓN PARA SU COBRO de TRES (03) Cheques del Banco Banesco Banco Universal respectivamente, Agencia Puerto Píritu, distinguido con los Nos. 36303389, 48303390, 23303391, emitidos en la ciudad de Puerto Píritu, en fecha 18 de Febrero del 2009, por un monto que asciende a la cantidad de: SESENTA Y CUATRO MIL NOVECIENTOS CUARENTA Y NUEVE BOLÍVARES CON 00/100 CENTIMOS (Bs. F. 64.949,oo) nombre del ciudadano: J.M.O.R., titular de la cédula de Identidad Nº V- 10.294.830, en contra del ciudadano: J.L.R.M., venezolano, mayor de edad, titular de la cédula de identidad nº V- 8.801.848, domiciliado en la Calle Principal de la Urbanización Las isletas de Puerto Píritu, Municipio Peñalver, Estado Anzoátegui.- SE ABRE EL PRESENTE CUADERNO DE MEDIDAS, el cual forma parte del expediente Nº C_M- 1.164-09.- Ahora bien en relación a la Medida Preventiva de Embargo solicitada, sobre bienes muebles propiedad del demandado: J.L.R.M..- El Tribunal llenos como se encuentran los extremos de ley, de conformidad con lo establecido en los artículos 585, ordinal 1º del 588 en concordancia con el articulo 646 del Código de Procedimiento Civil, DECRETA el Embargo Preventivo sobre bienes muebles propiedad del demandado: J.L.R.M., venezolano, mayor de edad, soltero, domiciliado en la calle principal, Edificio Nº E, Planta Baja, Apartamento PB-1E, Urbanización Las Isletas, Puerto Píritu, Municipio Peñalver del Estado Anzoátegui y titular de la cedula Nº 8.801.848.
Que la cantidad a Embargar, si se trata de sumas liquidas de dinero, debe cubrir el monto de la suma demandada, mas las costas procesales es decir, la cantidad de: SESENTA Y CUATRO MIL NOVECIENTOS CUARENTA Y NUEVE BOLÍVARES CON 00/100 CENTIMOS (Bs. F 64.949,OO), más DIECISEIS MIL DOSCIENTOS TREINTA Y SIETE BOLÍVARES CON VEINTICINCO CENTIMOS (Bs F.16.237,25), para un total de: OCHENTA Y UN MIL CIENTO OCHENTA Y SEIS BOLÍVARES CON 00/100 CENTIMOS (Bs.F. 81.186,25).
Que en caso de que la Medida Preventiva recaiga sobre bienes muebles propiedad del demandado, debe cubrir el doble de la suma demandada, es decir la cantidad de: CIENTO VEINTINUEVE MIL OCHOCIENTOS NOVENTA Y OCHO BOLÍVARES (Bs. F. 129.898,oo), mas las costa procesales, es decir la cantidad de: DIECISEIS MIL DOSCIENTOS TREINTA Y SIETE BOLÍVARES CON VEINTICINCO CENTIMOS (Bs F.16.237,25), para un total de: CIENTO CUARENTA Y SEIS MIL CIENTO TREINTA Y CINCO BOLÍVARES CON VEINTICINCO CENTIMOS (Bs. 146.135,25). Librese oficio y exhorto al tribunal Ejecutor de medidas de los Municipios F.d.P. , Píritu y San J.d.c.d. esta Circunscripción Judicial, a los fines de ley.
