Le corresponde a este Tribunal decidir acerca del sobreseimiento de la presente causa signada con el Nº 1C-1268-06, seguida al ciudadana Y.H., y como victima: M.V. , venezolana, mayor de edad, titular de la cedula de identidad Nº , previa solicitud interpuesta por la Fiscal Primero del Ministerio Publico, Abg. J.C. TABARES.

Mediante denuncia realizada por la ciudadana: M.V. , venezolana, mayor de edad, y con C.I 4.098.146, quien manifestó mediante denuncia, lo siguiente: Ella ingreso al hospital presentando dolor abdominal y sangramiento genita, fue atendida por la Doctora, E.V. y por mi persona, yo procedí a entrevistarme con la paciente, y la misma me manifestó que ella habia tomado unas pastillas de nombre METERGIN, con la finalidad de que le bajara la regla, y me dijo que se encontraba embarazada, la pasamos a la sala de ginecologia, y la examinamos, notamos que sangraba Calota Fetal que quiere decir la cabecita del bebe que se encontraba allí.
Considera este Tribunal, que una vez revisadas las actas que conforman el presente expediente, se vislumbra que, existe el delito. ABORTO, previsto y sancionado en el articulo (s) 432, vigente para el momento ocurrido de los hechos (Hoy 430) CODIGO PENAL, por lo que de igual manera este Tribunal. observa que desde el 08-05-00, hasta la actual data 21-09-2006, han transcurrido, cuatro (6) años, y cuatro meses, (7) días, dicho acontecimiento se encuentra evidentemente prescrito en conformidad con 108 ordinal 5º del Codigo Penal, es por lo que de conformidad con el articulo 318 ordinal 3º del Código Orgánico Procesal Penal, es por lo que este tribunal de Control considera procedente y ajustado a Derecho, decretar EL SOBRESEIMIENTO DE LA CAUSA.
DECISION
Por todos los razonamientos antes expuestos este Tribunal de Primera Instancia, Primero en Funciones de Control ADMINISTRANDO JUSTICIA EN NOMBRE DE LA REPUBLICA BOLIVARIANA DE VENEZUELA Y POR AUTORIDAD DE LA LEY DECRETA EL SOBRESEIMIENTO DE LA CAUSA a favor de Y.H.. Nº 1C- 1268-06, en perjuicio de M.V. Con fundamento en el articulo 318 Ord. 3º del Código Orgánico Procesal Penal, el cual se lee: “Articulo 318 Sobreseimiento. El sobreseimiento procede cuando: 3º”La acción penal se ha extinguido o resulta acreditada la cosa juzgada ”. Así se decide. Respétese el lapso de apelación y una vez vencido remítase al archivo judicial Notifíquese a las partes de la presente decisión.
