La necesaria reforma del régimen
de las consultas tributarias en España

Resumen: El estudio aborda la necesidad de refor-
mar el régimen español de las consultas tributarias,
a partir del desarrollo del derecho a consultar, los
sujetos y objeto de la consulta, el plazo de resolución
y la tipología del silencio administrativo aplicable,
entre otros aspectos, ofreciendo sus conclusiones y
recomendaciones.
Palabras claves: Consultas tributarias, derecho sub-
jetivo, vinculación, silencio positivo, recurribilidad,
consulta simplificada, sanciones.
Abstract: This study addresses the need to reform the
Spanish tax rulings regime, based on the right to get a
ruling, the subjects and objects of the ruling, the ruling
period, and the type of administrative silence applicable,
among other aspects, offering its conclusions and recom-
mendations.

I. INTRODUCCIÓN
El régimen vigente de las consultas vinculantes se con-
tiene en los artículos 88 y 89 de la Ley General Tributaria y en
la Subsección Segunda del Capítulo II del del Título III del Real
Decreto 1065/2007, de 27 de julio, por el que se aprueba el Re-
glamento General de las actuaciones y los procedimientos de
gestión e inspección tributaria y de desarrollo de las normas
comunes de los procedimientos de aplicación de los tributos
(artículos 65 a 68). Se trata de lo que podríamos denominar ré-
gimen general, pues existen dos supuestos especiales de con-
sulta, como serían la valoración de inmuebles (artículo 90 de la
