SALA CONSTITUCIONAL DEL TRIBUNAL SUPREMO
DE JUSTICIA A EJERCER SU POTESTAD DE REVISIÓN
CONSTITUCIONAL CONVALIDA UNA VIOLACIÓN
AL DERECHO DE PROPIEDAD DE LA
ARRENDADORA DE UN INMUEBLE

Resumen: El presente artículo reseña sendos fallos de primera y segunda instancia,
dictados con ocasión del ejercicio de una acción de retracto arrendaticio sobre un
inmueble de propiedad de un particular, ubicado en el estado Lara, así como el dic-
tado por la Sala Constitucional del Tribunal Supremo de Justicia, la cual, al negarse
a revisar la sentencia de segunda instancia, convalidó la violación al derecho consti-
tucional de propiedad causada por los referidos tribunales de instancia.

Abstract: This article reviews two first and second instance rulings issued with re-
gard to a tenant’s legal action to repurchase a private-owned property located in
the state of Lara, as well as that issued by the Constitutional Chamber of the Su-
preme Court of Justice, which by refusing to review the ruling issued by the appeal
court, endorsed the violation of the right to property inflicted by the af orementio-
ned first instance and appe al courts.

I. EL MARCO JURÍDICO APLICABLE EN EL PRESENTE CASO
El arrendamiento de inmuebles comerciales en Venezuela se encuentra actualmente re-
gulado por el Decreto con Rango, Valor y Fuerza de Ley de Regulación del Arrendamiento
Inmobiliario para el Uso Comercial (Gaceta Oficial Nº 40.418 del 23 de mayo de 2014), cuya
Disposición Derogatoria Primera sustrae a los inmuebles comerciales de la aplicación del
Decreto con Rango, Valor y Fuerza de Ley de Arrendamiento Inmobiliario (Gaceta Oficial
N° 36.845 del 7 de diciembre de 1999).
Este Decreto-Ley, destinado a regular el arrendamiento de inmuebles para uso comer-
cial, prevé la figura de la ‘preferencia ofertiva’ en los siguientes términos:
