Resumen: El ensayo diserta sobre la Norma Fundamental (Grundnorm), condi-
cionante de última instancia de las modificaciones constitucionales, y su recono-
cimiento por la Cort e Suprema de Justicia.

Abstract: The essay discusses the concept of the (Grundnorm) as the ultimate con-
ditioner of constitutional reforms, and its recognition by the Venezuelan Supreme
Court of Justice.

I. INTRODUCCIÓN
El Ejecutivo anunció su intención de dar inicio al proceso conducente a una ambiciosa
modificación de la Constitución venezolana a mediados del mes de enero de 20251. Ambicio-
sa, decíamos, porque aunque de las modificaciones que se pretende introducir al Texto Fun-
damental poco o nada se sabe2, ha sido dicho que la modificación propuesta abarcará unos 80
artículos.
La elaboración de las normas constitucionales que han de plasmar ideas tan vagas como
la de diseñar «un nuevo modelo económico “no dependiente, autosuficiente”», o actualizar el
«engranaje constitucional “a la luz de los nuevos términos globales”», ha sido encomendada
a una Comisión que dista mucho de representar a la sociedad, como un todo3. Mal comienzo.
Frente a tanta incertidumbre hemos estimado pertinente retomar uno de los postulados
fundamentales sobre los cuales descansa nuestro Derecho Constitucional: independientemen-

Rafael Badell Madrid, a través de sendos artículos intitulados “La ‘reforma constitucional’ de
2025 para eliminar la democracia representativa y la descentralización política, y consolidar el to-
talitarismo: propósito, antecedentes, y las exigencias del momento constituyente actual que vive
Venezuela” y “Modificación Constitucional”, respectivamente, que también aparecen publicados
en este Boletín de la Academia de Ciencias Políticas y Sociales.
