AUTO ACORDANDO DESIGNACIÓN DE DEFENSOR PUBLICO
Recibida como ha sido solicitud por parte de la Abg. M.G.M., actuando en su carácter de Fiscal Sexta del Ministerio Público, para que se le designe defensores públicos, a los Adolescentes OMISSIS 1 y OMISSIS 2; a quienes se les aperturó averiguación, por la presunta comisión de uno de los delitos contra las personas, en perjuicio de: J.G.F., a los efectos de que los asistan en los actos del proceso, por cuanto los adolescentes carecen de medios económicos suficientes para pagar a un abogado privado.
Ahora bien, este Tribunal observando que el Literal “C” del artículo 654 de la Ley Orgánica Para la Protección del Niño y del Adolescente, establece: “Artículo 654. Imputado. Todo adolescente señalado como presunto autor o partícipe de un hecho punible tiene derecho desde el primer acto de procedimiento, a: (…) c) Ser asistido por un defensor nombrado por él, sus padres o responsables y, en su defecto por un defensor público. (…).”. por su parte el artículo 657 del mencionado texto legal prevé: “Artículo 657. Constitución de la Defensa. Una vez designado el defensor privado o público, este manifestará su aceptación ante el juez sin más formalidades.”
Este Tribunal, actuando en Nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley: Acuerda la designación de Defensor Público Penal, para que asista a los Adolescentes OMISSIS 1 y OMISSIS 2; a cuyos efecto, se ordena notificar a la Coordinación de la Unidad de Defensoría Pública de este Circuito Judicial Penal, a objeto que designe defensor correspondiente. Líbrese Oficio respectivo. Cúmplase-
