RESUMO
Neste ensaio foram observados aspectos importantes das deliberações do júri e como a
democracia se apresenta nessas situações. Usou -se como objeto de análise duas passagens
da Grécia Antiga, uma da ficção teatral e, a outra, um relato históri co. A Eumênides, escrita por
Ésquilo, e a Apologia de Sócrates, nas versões de Platão e de Xenofonte, são exemplos
instigantes de deliberações democráticas em tribunais. Nelas, o que se decide é a vida ou a
morte do réu. As características da democracia foram analisadas para a melhor compreensão
dos traços deliberativos de um júri. Os pensamentos de René Girard, Nietzsche e Hobbes
ajudaram a compreender aspectos da antropologia filosófica, no que diz respeito principalmente
à natureza humana, de tal modo a esclarecer questões sobre o agir que interferem no julgamento
e que podem ser úteis para o aprimoramento do sistema democrático. Utilizou -se o método de
pesquisa qualitativo bibliográfico, com ênfase na apreciação dos textos literários, tendo po r
objetivo a busca de inferências corroboradas pelo pensamento dos autores supracitados.

On orestes and socrates: democracy deciding between life and death
ABSTRACT
Important aspects of the jury's de liberations and how democracy presents itself in these
situations were observed in this essay. Two passages from Ancient Greece were used as the
object of analysis, one from theatrical fiction and the other from a historical report. The
Eumenides, written by Aeschylus, and the Apology of Socrates, in versions by Plato an d
Xenophon, are thought -provoking examples of democratic court deliberations. In them, what is
