Resumen
El tema de los Principios en el ámbito de las Ciencias Jurídicas es, sin lugar a dudas, de
profundo interés y permanente vigencia, al ejercer una función esencial en cualquier rama del
Derechopues, toda construcción normativa exige una serie de orientaciones o
preceptoscapaces de responder a la naturaleza de los supuestos que regula y dar sustento
a toda su estructura conceptual.Esto justifica el interés de ahondar sobre cuáles son esas
directrices que han servido de fundamentoal Régimen Prestacional de la Seguridad y Salud
Laboral en Venezuela, concebido con base a los lineamientos del Convenio 155 sobre Salud
y Seguridad de los Trabajadores de la Organización Internacional del Trabajo (OIT) y la
Constitución de la República Bolivariana de Venezuela (1999). En tal sentido, la Ley Orgánica
de Prevención, Condiciones y Medio Ambiente de Trabajo (2005), ley especial en la
materia,dispone que dado el carácter eminentemente técnico del Régimen, existe un conjunto
de aspectos que deben ser regulados a través de Normas Técnicas, entre ellas la relativaa la
metodología para la elaboración del Programa de Seguridad y Salud en el Trabajo (NT-01-2008)
y al proceso para la Declaración de Enfermedad Ocupacional (NT-02-2008).De ahí la necesidad
de abordar cómolos Principios, de Legalidad, Publicidad, Generalidad, Territorialidad, de
Participación Protagónica, de Periodicidad, de Igualdad y No Discriminación, Confidencialidad,
Gratuidad, Veracidad de la Información, Inmediatez,Cooperación y Responsabilidadhan servido
de verdades inspiradoras no sólopara informar al Legisladoral momento de crearlas sino
queadicionalmentesonde utilidad para el intérprete que pretende aplicarlas, convirtiéndose,
dado su carácter instrumental, en referente para las que han de ser dictadas en un futuro, al
demarcar cómo actuar para lograr el resultado deseado,a saber, garantizar el ejercicio pleno
de las facultades físicas y mentales de los trabajadores.

Abstract
The theme of the Principles in the field of legal science is, no doubt, of deep interest and
permanent force, to exercise an essential role in any branch of law therefore all normative
construction requires a set of guidelines or precepts capable of respond to the nature of the
assumptions that regulates and give support to all its conceptual structure. This justifies the
interest elaborate on what those guidelines that have served as the basis to Benefit System
Safety and Health in Venezuela, conceived based on the guidelines of Convention 155 on
Health and Safety of Workers of the International Labour Organization (ILO) and the Constitution
of the Bolivarian Republic of Venezuela (1999). In this regard, the Organic Law on Prevention,
Conditions and Working Environment (2005), special law on the subject, provides that given
the highly technical nature of the scheme, a set of aspects that should be regulated through
Technical Standards , including on the methodology for program development Safety and
Health at Work (NT-01-2008) and the process for the Declaration of Occupational disease (NT-
02-2008). Hence the need to address how the Principles of Legality, Advertising, Generalitat,
territoriality, of active participation, Periodicity, Equality and Nondiscrimination, Confidentiality,
Gratuity, Accuracy of Information, Immediacy, Cooperation and Responsibility have served
truths inspiring not only to inform the Legislator when creating them but are additionally useful
for the interpreter who intends to apply, becoming, given its instrumental character in relation
to those to be issued in the future, to demarcate how to act to achieve desired result, namely
to ensure the full exercise of physical and mental capabilities of workers.
