Resumen:Por los fundamentos expuestos, esta Sala Segunda de la Corte de Apelaciones del Circuito Judicial Penal del Estado Zulia, administrando justicia en nombre de la República y por autoridad de la ley, DECLARA: PRIMERO: CON LUGAR, el recurso de apelación de autos interpuesto por los profesionales del Derecho J.S.S. y A.M.A., Fiscal Provisorio y Auxiliar adscritos a la Fiscalía Vigésima Séptima (27°) del Ministerio Público, con competencia en Ejecución de la Sentencia de esta Circunscripción Judicial del estado Zulia, al haber constatado esta Sala que efectivamente no ha transcurrido el lapso establecido en el artículo 112 del Código Penal, referente a la prescripción de la Pena. SEGUNDO: REVOCA, la decisión No. 112-2016, emitida en fecha 10.02.2016, por el Juzgado Quinto de Primera Instancia en Funciones de Ejecución del Circuito Judicial Penal del estado Zulia, mediante la cual entre otros aspectos, decretó la extinción de la pena por prescripción, a fa.....
