ASUNTO : BH12-V-2003-000004

Revisadas como han sido las actas que conforman el presente expediente, concretamente la comisión conferida al Juzgado del Municipio San J. deG. delE.A., se ha podido constatar, que la Boleta de notificación la cual fue librada de conformidad con lo establecido en el artículo 218 del Código de Procedimiento Civil, además de que fue suscrita por la Juez del Despacho, siendo lo correcto que fuera suscrita por el Secretario, se incurrió en el error de expresar que el procedimiento es por COBRO DE BOLIVARES (VIA INTIMATORIA), siendo lo correcto, que es COBRO DE BOLIVARES (ORDINARIO), igualmente en la referida boleta se expresa textualmente:

Se le notifica de conformidad con el Artículo 218 del Código de Procedimiento Civil, que una vez constado en autos de dicha notificación, deberá comparecer ante este Juzgado de la causa, dentro de los diez (10) días de Despacho siguientes a su intimación, con el objeto de que pague al demandante

.-

Expuesto lo anterior, y a los fines de aplicar una recta y sana administración de justicia, y tomando en consideración que el Juez debe corregir las faltas que puedan acarrear la nulidad de las actuaciones con evidente violación a la economía procesal, y es obligación del Juez como director del proceso remediar el desequilibrio procesal, es por lo que, este Tribunal, de conformidad con lo establecido en el artículo 206 del Código de Procedimiento Civil, y 26 de la Constitución de la República Bolivariana de Venezuela, REPONE la causa al estado de que se practique nuevamente la citación de la parte demandada, dando estricto cumplimiento a lo establecido en el articuló 218 del Código de Procedimiento Civil, y así se decide.-

Esta decisión se dicta Administrando Justicia en nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley.-
