Extradition — Procedure of — Treaty between Cuba and Venezuela, 1910 — Passive extradition — The law of Venezuela.

The Facts.—Court No. 7 of First Instance of the Judicial Area of the Federal District and the State of Miranda petitioned the Federal Court to request the extradition from Cuba of Simón Alejos Bereciartu on a charge of falsifying cheques.

Held: that a request for extradition should proceed.

The Federal Court found that the offence of falsification of cheques was penalized by six to eighteen months' imprisonment according to Article 322 of the Penal Code, that it was included among the extraditable offences listed in Article II (10) of the Extradition Treaty with Cuba of July 14, 1910, and that the record submitted with the petition of the trial Court conformed to the requirements of Article 390 of the Code of Criminal Procedure...
