Resumen: Esta recensión se refiere a la investigación realizada por la Dra. Jessi-
ca Vivas Roso, sobre el tema de la responsabilidad administrativa en Venezuela,
particularmente en los con textos de severa opacidad instit ucional del país, desta-
cando el análisis crítico que realiza sobre el tema orientado a determinar si la
institución cumple efectivamente su finalidad esencial: la protección del patrimo-
nio público frente a conducta s que lo menoscaben.

Abstract: This review refers to the research carr ied out by Dr. Jessica Vivas Roso,
on the subject of administrat ive responsibility in Venezuela, particularly in the con-
texts of severe institutional op acity of the country, highlighting the critical analysis
she carries out on the subject aimed at determining whether the institution effec-
tively fulfills its essential purpose: the protection of public assets against behaviors
that undermine it

La monografía de la profesora Jessica Vivas Roso constituye una de las aportaciones
más completas y sistemáticas que se han producido en los últimos años dentro de los estudios
contemporáneos sobre el control de la Administración pública y, d e modo particular, sobre la
responsabilidad administrativa en Venezuela. El libro es fruto de una investigación doctoral
desarrollada en la Universidad de La Coruña y reconocida con el Premio Antoni Pedrol i
Rius a la mejor tesis doctoral, distinción que evidencia tanto el rigor me todológico como la
relevancia práctica del trabajo, más aún en contextos de severa opacidad institucional, lo que
otorga un valor adicional a sus conclusiones. Desde sus primeras páginas se advierte que no
se trata de un estudio meramente descriptivo, sino de un análisis crítico orientado a determi-
nar si la institución cumple efectivamente su finalidad esencial: la protección del patrimonio
público frente a conductas que lo menoscaben. La autora logra articular una obra de madurez
académica que dialoga con la práctica administrativa venezolana y propone reformas concre-
tas para superar las disfunciones detectadas.
I. CONTEXTO Y SENTIDO DE LA INVESTIGACIÓN
El estudio se inserta en un escenario particularmente complejo para el derecho público
venezolano. La crisis institucional, la debilidad de los mecanismos de transparencia y las
tensiones políticas han transformado al sistema de control fiscal en un espacio de disputas
donde con frecuencia se confunde la defensa del erario con la persecución de adversarios.
