Corresponde a esta Alzada pronunciarse sobre la admisibilidad del recurso de revisión interpuesto el 30-5-2013 por la Abg. RINALDA B.G.M., en su condición de Defensora Pública 2ª de la Coordinación Regional de la Defensa Pública de la Extensión Guasdualito del Estado Apure, Defensor del ciudadano L.G.G.S., de conformidad con lo establecido el numeral 6 del artículo 462 del Código Orgánico Procesal Penal, contra la sentencia dictada el 23-7-2010 por la Juez 1ª de Primera Instancia en funciones de Juicio del Circuito Judicial Penal de la Circunscripción Judicial del Estado Apure, Abg. N.M.R., mediante la cual condenó a la ciudadana antes señalado a cumplir la pena de 8 años de prisión, como responsable de la comisión del delito de Transporte de Sustancias Estupefacientes en la Modalidad de Ocultamiento; previsto y sancionado en el artículo 31 de la Ley Orgánica contra el Trafico Ilícito y Consumo de Sustancias Estupefacientes y Psicotrópicas vigente para el momento en que ocurrieron los hechos. La sala pasa a pronunciarse en los siguientes términos:
Por no configurarse ninguno de los supuestos de inadmisibilidad establecidos en el artículo 428 del Código Orgánico Procesal Penal, se admite la pretensión de conformidad con lo establecido en el artículo 447 eiusdem, en concordancia con el numeral 6 del artículo 462 y 466 ibidem.
En cuanto a las pruebas ofrecidas por la abogada Rinalda B.G.M., consistente en la copia certificada de la sentencia definitivamente firme dictada en la presente causa el 23 de julio de 2010, se declara inadmisible por innecesario, toda vez que el procedimiento por revisión de sentencia obliga al Tribunal de Primera Instancia la remisión a la Alzada de las actuaciones originales; en cuanto a la copia de la decisión emitida por la Corte de Apelaciones del Circuito Judicial Penal del Estado Vargas, y copia de la Decisión emitida por la Corte de Apelaciones del Circuito Judicial Penal del Área Metropolitana de Caracas, se declaran inadmisibles por cuanto no cumplen con las exigencias del artículo 445 del Código Orgánico Procesal Penal.
Se acuerda fijar para el día Martes 3-12-2013 a las 2:15 p.m., la celebración de la audiencia oral a la cual se refiere el artículo 448 del Código Orgánico Procesal Penal. Cítese a las partes. CUMPLASE.
