Abstract: This Commentary highlights the temporal incongruity, not considered by
the Constitucional Chamber, of the Decree of State of Exception of External Com-
motion, issued in the Council of Ministers and signed by Nicolás Maduro as Presi-
dent and all the Ministers on January 3, 2026, and which was published in the Of-
ficial Gazette of that same day, January 3, 2026, despite the fact that in the early
hours of the morning of that same day the “forced absence” of Nicolas Maduro
had already taken place, due to its forced extraction from the country, and the Ex-
ecutive Vice President was on the Island of Margaritas, which made it impossible
for there to have been any Council of Ministers, nor adoption of said Decree that day.
Key words:. State of Exception of External Commotion.
