Vista la diligencia presentada en fecha 10.6.09, por el abogado R.A.S., inscrito en el Instituto de Previsión Social del Abogado bajo el N° 12.967, actuando en su carácter de apoderado judicial de la Sucesión R.B.C., mediante la cual solicita se revoque el nombramiento del experto designado por el Tribunal ciudadano P.G., y se proceda a designar a otro, alegando que, “la prueba de experticia promovida por mi representada no se ha evacuado motivado a la imposibilidad de la notificación por este Juzgado de Sustanciación al perito designado por el mismo”; asimismo, se acuerde prorrogar el lapso de evacuación de pruebas; este Juzgado, como quiera que se evidencia de las actas que conforman el presente expediente la diligencia del Alguacil de esta misma fecha, mediante la cual consigna la boleta dirigida al mencionado experto en virtud de que le fue imposible su ubicación, acuerda nombrar como experto al ciudadano J.G., a quien se ordena notificar para que comparezca en el tercer (3er.) día de despacho siguiente a su notificación, a las once horas de la mañana (11:00 a.m.)., a los fines de su aceptación o excusa, y en el primero de los casos, preste juramento de Ley. Líbrese boleta.
En virtud de lo decidido, se acuerda prorrogar por quince (15) días de despacho, el lapso de evacuación para la prueba en cuestión, contados a partir del vencimiento del lapso anterior.
