ALGUNOS TEMAS SELECTOS SOBRE
LA PROTECCIÓN DE LA CONFIANZA*
– Apuntes para el XXXVI encuentro de la
Asociación Venezolana de Derecho Administrativo (AVEDA),
celebrado el 24 de septiembre de 2025 –

Resumen: El texto analiza el princip io constitucional de protección de la confian-
za en el Derecho Administrativo, destacando su nacimiento jurisprudencial en el
caso de la “Viuda de Be rlín” (1956), su ausencia de reconocimiento expre so en
Venezuela y otros ordenamientos, y la discusión doctrinal sobre su fundamento ju-
rídico. Se insiste en su dimensión temporal y se distingue entre la idea amplia de
confianza como valor general y el principio como técnica concreta de control de la
actividad estatal. Finalmente, se ilustra con la sentencia de 1956 que un acto ad-
ministrativo nulo puede genera r una situación de confianza digna de prote cción
cuando el particular ha modif icado su situación sobre la ba se de ese acto, lo que
exige al poder público ponderar los intereses c olisionados y no revocarlo “sin
más” solo por su nulidad

Abstract: The text analyzes the constitutiona l principle of protection o f trust in
Administrative Law, highlighting its birth through case law in the so‑called
“Widow of Berlin” case (1956), its lac k of express recognition in Venezuela and
other legal systems , and the doctrinal de bate over its lega l foundation. It stre sses
the principle’s temporal dimension and distinguishes between the broad idea of
trust as a general value and the principle itself as a concrete technique for contro-
lling public activity. Finally, it illustrates, through the 1956 judgment, that a void
administrative act may generate a situation of trust worthy of protection when the
individual has changed their position on the basis of that act, requiring the public
authority to weigh the conflicting interests and not revoke the act “simply” becau-
se it is void.
