La in serción de las norm as jur ídicas en el tie mpo es prob lema d e much os
lad os, per o siem pre, d esde la pers pectiva de la do gmát ica jur ídica, gir ará,
en su r azón fu ndam ent al, en t orno a la búsqu eda d e la nor ma a plicable al
caso concret o. Como se sabe, el tiem po es u na cat egoría conceptual de la
experiencia que, a su vez, hace referencia, al menos, a las ideas de
sim ulta neid ad, su cesión y dur ación y d esde la per spect iva de la aplicac ión
de la norma, de la limitación de su eficacia, a los conceptos de pasado,
presente y futuro. In teresa obviamente no el tie mpo subjetivo, el de cad a
cua l, sino el tiem po hist órico (el tie mpo del se nti do com ún ) com o cat egoría
de la rea lidad socia l. El tie mp o de la s no rma s jur ídica s ha ce re feren cia t ant o
a la d uración como a la sucesión. Las nor mas son eficaces hasta que son
derogadas (duración) y, de esta forma, una determinada parcela de la
con duct a hu man a qu edar á regu lada de ot ra for ma, más o men os difer ent e
(su cesión de n orm as) . A veces, sin má s, un a n orm a dej a de t ene r vigen cia y
no le sucede ningu na ot ra, porque la realid ad re gulada ha desap arecid o o
por que no n ecesit a ser regula da. La vigencia y la der ogació n de las no rma s
son necesidades estructurales que las hace discurrir en un tiempo
det erm inad o. Suced e a veces , sin em bar go, que las no rma s han de re gular
rea lidad es qu e exist ieron ant es de ser d ictad as o qu e cont inú an exi stien do
pu es em pezar on a ntes de dic tars e la no rm a. Est a cons tata ción s e refie re al
conjunto de problemas inmerso en los conceptos de irretroactividad o
ret roact ividad de las no rmas .
