EL TRIBUNAL SUPREMO DE JUSTICIA AVALA DESPIDO
DE JUEZAS PROTEGIDAS POR MATERNIDAD Y SALUD*

Resumen: La Sala Político Administrativa del Tribunal Supremo de Justicia de
Venezuela ratificó en recientes decisiones la potestad de la Comisión Judicial para
remover jueces provisorios sin procedimiento previo, sin motivación y sin derecho
a la defensa, incluso en casos de fueros especiales. Una jueza fue separada de su
cargo durante su permiso postnatal y otra mientras estaba de reposo médico, ne-
gándose en ambos casos la aplicación efectiva de las garantías del fuero maternal
y de salud. Aunque se ordenó el pago de salarios y beneficios, se rechazó la rein-
corporación, desconocie ndo estándares internacionales ratificados por Venezuela,
como los Convenios de la OIT, la CEDAW, el PIDESC y la Conve nción Americana
sobre Derechos Humanos. Estas decisiones evidencian la persistencia de la figura
de jueces provisorios, contraria a la Constitución y a los tratados internacionales
ratificados por Venezuela, y ponen de manifiesto la discrecionalidad de la Comi-
sión Judicial como mecanis mo de control político en detrimento de la indepen den-
cia judicial. En consecuencia, se debilita el Estado de derecho y se afecta el dere-
cho ciudadano a ser juzgado por jueces naturales, imparc iales e independientes.

Abstract: The Political-Administrative Chamber of the Supreme Court of Justice of
Venezuela recently reaffirmed the authority of the Judicial Commission to remove
provisional judges without prior proceedings, reasoning, or the right to defense, even
in cases involving special protections. One judge was dismissed during her postnatal
leave and another while on medical leave, with the Court denying in both cases the
effective application of maternity and health-related guarantees. Although the pay-
ment of salaries and benefits was ordered, reinstatement was denied, disregarding in-
ternational standards ratified by Venezuela, such as the ILO Conventions, CEDAW,
the ICESCR, and the American Convention on Human Rights. These rulings highlight
the persistence of provisional judges, in violation of the Constitution and internatio-
nal treaties ratified by Venezuela and reveal the discretionary role of the Judicial
Commission as a mechanism of political control to the detriment of judicial indepen-
dence. Consequently, the rule of law is weakened and citizens right to be judged by
natural, impartial, and independent judges is impaired.
