Partes:Tribunal Trigésimo Sexto de Primera Instancia de Sustanciación, Mediación y Ejecución del Circuito Judicial del Trabajo de la Circunscripción Judicial del Área Metropolitana de Caracas eleva consulta de sentencia dictada en fecha 30.05.2014, con motivo de la demanda interpuesta por el ciudadano M.d.J.O.M. contra el Instituto Nacional de Deportes, por calificación de despido, reenganche y pago de salarios caídos.
Decisión:La Sala ordena oficiar al Presidente del Instituto Nacional del Deporte, para que dentro de un lapso de diez (10) días de despacho contados a partir de que conste en autos su notificación, informe a esta Sala si la relación que mantenía el ciudadano M.d.J.O.M., era contractual o funcionarial, a los fines de precisar el régimen legal que le es aplicable; en caso de tratarse del primer supuesto, deberá remitir a esta Sala el último contrato de trabajo suscrito entre el accionante y ese Instituto.
